If you grant exclusivity, bound it by term, scope and a performance trigger
Buyers and marketplaces describe the same three limits. Troveo's guide lists a term, a scope (a category or a use) and a performance trigger that releases exclusivity if the deal has not produced an agreed amount by a set date. Labelbox lists single-buyer access, category restrictions and time-based windows. HUMXN's template limits exclusivity to the field of use and period the order form states. Troveo's own agreement makes exclusivity time-limited.

“A term, so exclusivity ends and the data comes back to market. A scope, so exclusivity covers a category or a use and leaves the rest free. A performance trigger, so exclusivity falls away if the deal hasn't produced an agreed amount by a set date.”

- Price exclusivity by what it covers: sole distribution earns a little more, sole use by one buyer earns a multiple
- Troveo: Exclusivity
- Find out whether the buyer starts from exclusive or non-exclusive before you read its price
- Ask every buyer for the non-exclusive price and the exclusivity premium as two separate lines
- Lead with what is not on the open web: that is what the labs say they pay for
- Uniqueness is written into the buyers' price formulas: show that the data exists nowhere else
It is shown on its own, not counted into a figure.
