Records / Negotiation levers

Eight booking and field-service systems' terms leave the records with the business, but several take a perpetual licence, own the aggregate and train their own AI

Six of the eight terms read by script say in terms that the business keeps its data (Calendly, Squarespace for Acuity, Square, Mindbody, Housecall Pro, ServiceTitan); SimplyBook.me makes the business the controller and itself the processor; Fresha has the Partner warrant that it owns what it provides. Square, Mindbody and Housecall Pro say they may train their own models on it; ServiceTitan says it will not train models for any third party on Customer Data; Mindbody, Housecall Pro and ServiceTitan each own the anonymised or aggregate layer; and ServiceTitan bars a franchisee from a mass export without its franchisor's consent. None of the eight contains a clause that bars the business from licensing its own records to a buyer.
