Treat the first bid on a distressed data asset as a floor and insist on an open auction

In the 23andMe sale (customer genetic data and the business around it) a three-day auction with seven bidders started at $52 million, Regeneron won it at $256 million, and TTAM then took the business at $305 million in a final round, nearly six times the opening bid; the court records that the price was $302.5 million in cash. Hilco, which ran the Rite Aid intangibles sale (brand, website and customer loyalty data), says the single-transaction price of $7.8 million was 'multiple times higher' than the values in the earlier investment-bank-led process.
