Virginia Consumer Data Protection Act, definitions (sale of personal data) (Va. Code 59.1-575)
In Virginia only an exchange for money is a "sale", so a paid licence of customer data to an AI developer is a sale the consumer can opt out of. A transfer for non-cash value (for example model access or credits) falls outside this definition, though other duties still apply.
