Fla. Stat. § 727.108: duties of an assignee for the benefit of creditors (Fla. Stat. § 727.108(1) (2026))
In an assignment for the benefit of creditors the assignee sells the assets, customer data included, under state law; section 363(b)(1) and the consumer privacy ombudsman do not apply outside bankruptcy, so the privacy policy and state and FTC law govern the sale directly.
